THE RECORDING INDUSTRY lost a major ruling in Atlantic v. Brennan when a federal judge in Connecticut ruled that merely making music available to other users is not evidence of copyright infringement. The judge also found that no proof of infringement was supplied by the record companies that brought the suit. With two of three findings going to the defendant, the case was thrown out. GOOGLE suffered a 7% drop in ad clicks from December to January and a .3% drop year over year according to comScore. Clicks also declined 7% between November and December. Wall Street responded to the news by hammering down Google's stock by as much as 8% during trading on Tuesday. While the company has not verified comScore's findings it did officially report substantially slowed growth during the fourth quarter. The cause may be any number of factors, from a tightening economy to increased success in battling click fraud. CBS reported a 15% decline in Q4 revenue and flat ad revenue due to slowdowns in TV and radio. Les Moonves said that the company would cutback on pilot expenditures, calling them "vastly overrated." He also tried to ease concerns about the slowing TV business by saying that "Network TV will always be a must-buy" for advertisers. (Maybe.) In other TV-slowdown news, DISH saw a 76% decline in subscriber gains during Q4. APPLE announced that iTunes has become the number two music retailer in the US, trailing only Wal-Mart in music sales during 2007. The store has 50 million customers and has sold 4 billion songs to date. The iTunes juggernaut continues. THE WGA ratified the new contract with the AMPTP with 93% of members voting to approve the deal. The contract is retroactive to February 13th and will be in effect until May 2, 2011. And the focus shifts to SAG. NBC UNIVERSAL will soon close the beta period for NBC Direct. The download service will officially launch sometime this quarter, though no specific date has been announced. NBC Direct will offer automatic copy-protected downloads of top NBC shows, including "The Office" and Conan O'Brien. Let's hope they fulfill the promise of Mac support in a reasonable time frame. ESPN will offer substantial online coverage of its first Masters tournament. Live streaming of the event will be offered to the handful of people that can actually access ESPN360.com. For the rest of us, video exclusives will be posted on Masters.org and live "look ins" will be available on ESPN.com. WARNER BROS. may lay off up to 1,000 workers as a result of the writers strike. The company issued 60-day warnings on November 12th in compliance with government regulations. With that period expiring, a Warner spokesperson confirmed that "some studio divisions will have to lay off employees." In related news, a major Hollywood payroll company has gone out of business partially due to decreased business during the strike. Also, ICM has begun cutting the pay of agents and executives by as much as 30%, while using force majeure rules to stop paying some agents all together. The impact of the strike seems to be increasing significantly. UNIVERSAL has dropped its exclusive support of HD DVD, giving yet another boost to Blu-ray. The studio will continue with the promotions it has already scheduled for the format and has not yet scrapped HD DVD support altogether. In related news, Paramount has an escape clause in its contract allowing it to get out if Warner drops support for HD DVD, which happened late last Friday. Paramount has not yet acted on that clause. Warner will fulfill its remaining HD DVD commitments through May 31st before going Blu-ray only. CBS has reached a tentative agreement with the WGA on new contracts for news writers. The deal will cover over 500 writers, editors and assistants that have been working without a contract since April 2005. It offers a 3.5% raise followed by another raise in 2009, as well as a cash payment for certain workers that did not receive a raise during 2007. The deal must be approved by union members before going into effect. APPLE will lower iTunes music prices in Britain after reaching an agreement with the European Commission. As a result, the Commission will drop charges against Apple stemming from the higher prices charged to British downloaders. Apple has contended that the music companies are forcing it to pay higher wholesale rates, which led to the higher iTunes prices. The company will lower prices within 6 months and reconsider contracts with labels that won't lower their wholesale rates. FYRE unveiled an impressive IPTV box this week that streams a large selection of DVD-quality video from multiple studios over the web. The box is free with monthly subscription packages and access to 20,000 titles. The catch? FyreTV was released at the "other" Expo in Las Vegas this week, the Adult Entertainment Expo. The box delivers on-demand IP-delivered adult programming to your TV. With the adult industry's ability to blaze new trails in video delivery, this may be a box to keep an eye on. APPLE will reportedly offer iTunes movie rentals from Warner Bros., Fox, Paramount, and Lions Gate. Rentals will cost $3.99 for 24 hours. An announcement is expected during the Steve Jobs keynote at Macworld on January 15th. HARVEY WEINSTEIN told reporters that WEINSTEIN CO. has signed an interim deal with the WGA. Weinstein called it a "done deal" that he expects to officially sign this morning. The self-declared "lightning rod" hopes the deal will push the major studios to return to the bargaining table. SONY BMG has officially announced that it will sell its entire catalog DRM-free on the Amazon MP3 download service. Amazon is now the only music download service selling unrestricted tracks from all four major labels. Dropping DRM has become a tactical necessity, as the labels look for a way to break Apple's stronghold on the music download market. Any serious iTunes competitor must offer iPod compatibility, a major benefit of the MP3 format. ECHOSTAR received CNET's Home Video "Best of CES" award for the TR-50, a digital-to-analog converter box. The feature-packed box includes a DVR that will record free over-the-air broadcasts of HDTV, a 7-day program guide to schedule recordings, an Ethernet connection for Internet functions and more. The TR-50 is the enhanced version of the stripped-down TR-40, a converter box that will be fully covered by the NTIA's converter coupon program. The TR-50 offers a compelling solution for consumers that don't have (or don't want) cable or satellite service. CBS will sell four TV stations to Four Points Media Group for $185 million. The deal finishes a round of medium and small market sell-offs for the network that began in 2006. CBS sold 11 TV stations and 39 radio stations during that time for almost $1 billion. It now owns 29 TV stations and 140 radio stations. THE FCC has given approval to a deal that will take Clear Channel Communications private for $19.5 billion. As part of the deal, the company will sell off 448 of its 1,150 radio stations. Shareholders have approved the deal and are now waiting for acceptance by the Justice Department.
